General labelling law

 

Royal Decree 1334/1999, of 31 July, approving the General Rules for labelling, presentation and advertising of foodstuffs incorporated different Community Directives published since 1979, and has been amended on various occasions. Directive 2000/13/EC performed a coding of all these Directives with respect to the labelling, presentation and advertising of the food products.

Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Commission Directive 87/250/EEC, Directive 90/496/EEC of the Council, Commission Directive 1999/10/E, Directive 2000/13/EC of the European Parliament and of the Council, Commission Directives 2002/67/EC and 2008/5/EC, and Commission Regulation (EC) No 608/2004.

As Directive 2000/13/EC was repealed so too was the Royal Decree tacitly repealed, with the exception of article 12 relating to the lot (regulated by Royal Decree 1808/1991 transcribing Council Directive 89/396/EEC, and which was not repealed by Regulation (EU) 1169/2011) and article 18 referring to the language used in the labelling. This article is included in national legislation, in accordance with the development capacity recognised for Member States by the European Commission

Article 12. Batch.

The identification of the batch is made in accordance with that laid down in Royal Decree 1808/1991, of 13 December, regulating the indications or marks identifying the lot to which a foodstuff belongs.

Notwithstanding the above, when referred to individual portions of ice cream, the indication enabling the lot to be identified shall appear on the combined package.

Article 18. Language of labelling.

The obligatory indications on the labelling of foodstuffs marketed in Spain shall, at minimum, be expressed in the official Spanish language of the State.

The above will not be applicable to traditional products prepared and distributed exclusively within the Regional Community with their own official language.
