Claims
If you should decide you wish to lodge a claim before the relevant Consumer Affairs Authorities and ensure that your claim is upheld, you should either go to the Local Consumer Rights Office (O.M.I.C.) in your town, or the Directorate General of Consumer Affairs in your Regional Community. These Administrations will start by mediating with the company with whom you are in disagreement, in order to smooth the way towards obtaining the most satisfactory result for both parties.
Many of these offices hold a form which provides guidance on how to lodge the complaint, although it is sufficient to provide a clean explication of your intention, identifying both the company against whom the complaint is made and yourself, without being held to any formalities.
Similarly, the establishments are legally bound to have a specific Complaints Form at your disposal. This instrument offers consumers and users the possibility of lodging their complaints at the place of occurrence, without this preventing the submission of a claim before the Consumer Affairs Administrations.
Notwithstanding the above, you may obtain adequate information about your rights and the exercise of the same from these Consumer Affairs Administrations, together with any other information related to consumer affairs.
In some cases the complaint lodged will serve as a starting point for the start of actions intended to establish the existence or non-existence of cases in which administrative penalties may be incurred.
You may also appeal to the Consumer Associations and other Organisations for certain specific sectors.
