New Regulation regarding electronic cigarettes

Royal decree-law 17/2017, of 17 November, amending Law 28/2005, of 26 December, on healthcare measures against smoking and regulating the sale, supply, consumption and advertising of tobacco, was published on 18 November in the Official Government Gazette, transposing Directive 2014/40/EU of the European Parliament and the Council, of 3 April 2014.
This Royal Decree-Law is one step more towards the completion of the transposition of the European Tobacco Products Directive, Directive 2014/40/EU of the European Parliament and the Council, of 3 April 2014.
The new features of this RDL include:
- Limits on the distance sales of nicotine-releasing devices such as electronic cigarettes and refill containers.
- The advertising, publicity and sponsorship of these devices will be approximated to that of tobacco products.
- Limits are established for the advertising, promotion and sponsorship of nicotine-releasing devices and refill containers.
- The placing on the market of tobacco for oral use is also prohibited
